ColorlyAI Terms and Conditions

Acceptance of Terms

By downloading or using the ColorlyAI mobile application (the "App"), you agree to be bound by these Terms and Conditions ("Terms"). This is a legally binding agreement between you and ColorlyAI. If you do not agree to these Terms, you must not use the App and should delete it from your device. We reserve the right to update or modify these Terms at our discretion. If we make material changes, we will notify you (for example, via an in-app notice). Your continued use of the App after any changes become effective constitutes acceptance of the new Terms.

Note: These Terms contain an arbitration provision and class action waiver that apply to users in certain jurisdictions (e.g. the United States). This means you agree that most disputes will be resolved through binding individual arbitration instead of in court, and you waive any right to participate in class actions or jury trials, to the extent permitted by law. Please review these provisions carefully.

Eligibility

You must be at least 13 years old to use ColorlyAI. The App is not intended for children under 13, and we do not knowingly allow such persons to use it. If you are between 13 and 18 (or the age of legal majority in your jurisdiction), you may use the App only under the supervision and with the consent of a parent or legal guardian who agrees to be bound by these Terms. By using the App, you represent that you meet these age requirements.

If we discover that a person under 13 has provided us with personal information or is using the App, we will take steps to terminate the account and delete any information as required.

User Accounts and Security

ColorlyAI may allow you to create an account or log in via third-party platforms (for example, signing in with your email or a social media account). If you choose to register or log in, you agree to provide accurate, up-to-date information and to keep your login credentials secure. You are responsible for all activity on your account.

You must promptly notify us at info@tease.tr if you suspect any unauthorized use of your account or security breach. We are not liable for any loss or damage arising from your failure to safeguard your account information.

Privacy

Your privacy is important to us. Please refer to the ColorlyAI Privacy Policy (available separately) for details on how we collect, use, and protect your information. By using the App, you acknowledge that you have read and understand our Privacy Policy.

User Content and Conduct

User Content

Our App allows you to upload or create content – specifically, you can upload your photos to simulate hair colors using AI, and you may share the resulting images ("User Content"). You retain ownership of all the photos and content you provide through the App; ColorlyAI does not claim ownership of your original images or the AI-generated results. However, to operate the service, you grant ColorlyAI a worldwide, non-exclusive, royalty-free, fully-paid license (with the right to sublicense) to use, reproduce, modify, adapt, create derivative works from, and display your User Content solely for the purpose of providing and improving the App's services to you.

This means, for example, that we have your permission to process your photos through our AI algorithms, cache them temporarily, and display the output back to you. This license is granted only for as long as you use the App and will terminate when you delete the content from the App or delete your account (except as needed for any legal compliance or backup requirements). ColorlyAI will not use your photos for any purpose other than providing the hair color simulation service, and we will not sell or share your images with unauthorized third parties.

Your Responsibilities

You are solely responsible for all content you upload or create using ColorlyAI. By uploading a photo, you represent and warrant that you own the photo or have all necessary rights and permissions to use it in the App and to grant the license above. Do not upload or share any photo or content that infringes anyone's privacy or intellectual property rights, or any content that is unlawful, harmful, hateful, obscene, or otherwise objectionable.

In particular, you must not upload any content depicting other individuals without their consent, any minors (under 18) without parental consent, or any content that is pornographic, violent, harassing, or discriminatory. You also agree not to use the App to do anything illegal, and not to attempt to circumvent any security measures or to disrupt the App's normal functioning (for example, no hacking, reverse engineering, or introducing viruses).

User Content Sharing

ColorlyAI may offer features to share your AI-generated hair color images (for example, sharing to social media or with other users). You are free to share your results, but please do so responsibly. ColorlyAI is not responsible for anything that happens to content once you share it outside our App. If you use a ColorlyAI free version that adds a watermark or logo to the output images, you agree that such watermark (which might be considered a form of advertising for ColorlyAI) may be applied to your transformed content.

In-App Purchases and Subscriptions

ColorlyAI is free to download, but certain premium features or content may require a purchase or subscription. If you choose to make a purchase (such as buying a premium feature or subscribing to a premium tier), the transaction will be processed through the Apple App Store (using your Apple ID account). All payments and refunds are handled by Apple under its App Store terms and payment policy. We do not directly collect or store your payment information.

Subscriptions

ColorlyAI may offer auto-renewing subscription plans (e.g., weekly or yearly subscriptions for premium features). If you subscribe, your subscription will automatically renew at the end of each billing period (e.g., weekly or annually) unless you turn off auto-renewal at least 24 hours before the end of the current period. Your Apple App Store account will be charged for renewal within 24 hours prior to the end of the current period at the price indicated.

You can manage or cancel subscriptions at any time via your App Store account settings. No cancellation of the current subscription is allowed during an active subscription period, and if you cancel, you will continue to have access to premium features until the current period ends. All fees are non-refundable once paid, except as required by law or as permitted by Apple's refund policies.

Intellectual Property Rights

All rights, title, and interest in and to the ColorlyAI App, including its software, code, design, logos, trademarks, graphics, and all content provided by ColorlyAI (excluding your own User Content), are the property of ColorlyAI or its licensors and are protected by copyright, trademark, and other intellectual property laws. ColorlyAI grants you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use in accordance with these Terms.

You may not copy, modify, distribute, sell, or lease any part of our App or included content, nor may you reverse engineer or attempt to extract the source code of the software, unless laws prohibit these restrictions or you have our written permission. All use of ColorlyAI's name, logos, and trademarks must be with our permission.

Termination

We reserve the right to suspend or terminate your access to ColorlyAI at any time, with or without notice, if you breach these Terms or engage in any behavior that we determine (in our sole discretion) is harmful to the App, other users, or any third party. If your account is terminated, you will lose access to the App and any data or content stored in your account.

In the event of termination, the license you granted to your User Content will terminate (except that we may retain copies for internal archival purposes or as required by law). Provisions of these Terms that by their nature should survive termination (such as indemnification, disclaimers of warranty, limitation of liability, etc.) will remain in effect.

Disclaimers

Use at Your Own Risk

Your use of ColorlyAI is at your sole risk. The App and all services and content provided through it are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. ColorlyAI disclaims any and all warranties, express or implied, including but not limited to implied warranties of title, merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the App will be uninterrupted, error-free, or free of viruses or other harmful components. Any information or advice obtained from ColorlyAI (for example, hair color recommendations) is for general informational or entertainment purposes and does not constitute any guarantee. We make no representations or warranties about the accuracy or completeness of any content or results obtained through the App.

Limitation of Liability

To the fullest extent permitted by law, ColorlyAI and its affiliates, officers, employees, and partners will not be liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of profits or revenues, arising out of or in connection with your use of (or inability to use) the App. This limitation of liability applies whether the claimed liability is based on breach of contract, tort, negligence, strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.

In no event will ColorlyAI's total liability to you for all claims arising from or related to the App exceed the amount (if any) that you paid to us for the service in the past 12 months, or $100 USD if you have not had any payment obligations. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you.

Governing Law and Dispute Resolution

These Terms and your use of the App are governed by the laws of the State of California, USA, without regard to its conflict of law principles. However, we operate globally and recognize that you may have rights under the consumer protection or data protection laws of your country of residence. Nothing in these Terms will limit any rights you may have under mandatory local laws.

For users in the United States, as noted above, you agree that any dispute or claim arising out of or relating to these Terms or the use of the App will be resolved by binding arbitration on an individual basis (not as a class action), pursuant to the Federal Arbitration Act and the rules of JAMS or another agreed-upon arbitration provider. You further agree that ColorlyAI and you are each waiving the right to a trial by jury or to participate in a class action lawsuit for such disputes.

Third-Party Services and Terms

ColorlyAI may integrate or make use of third-party services or SDKs (for example, the FAL.AI SDK for AI image processing, or social media sharing tools). We do not control third-party services, and they are provided for your convenience. Be aware that when you use a third-party feature, you are also subject to that third party's terms of service and privacy policy. You agree to comply with any applicable third-party terms when using the App.

Additionally, if you downloaded ColorlyAI via the Apple App Store, you acknowledge that Apple, Inc. is a third-party beneficiary to these Terms. This means that upon your acceptance of these Terms, Apple has the right to enforce these Terms against you as a third-party beneficiary. However, Apple has no obligation to support or warranty the App.

Miscellaneous

These Terms (and any additional policies or guidelines we provide, such as our Privacy Policy) constitute the entire agreement between you and ColorlyAI regarding the App, and supersede any prior agreements on the subject. If any provision of these Terms is held to be invalid or unenforceable, it will be interpreted to fulfill its intended purpose to the greatest extent permitted by law, and the remaining provisions will remain in full force and effect.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. We may assign our rights and obligations under these Terms to an affiliate or in connection with a merger or acquisition, but you may not assign or transfer your rights under these Terms without our consent.
